EchoReport is a product of Synthera Luminary Group
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Practitioner", "User", "you") and Synthera Luminary Group ("Company", "we", "us", "our") governing your access to and use of the EchoReport application and associated services (collectively, the "Service").
By registering for an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Cookie Policy, which are incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
You represent and warrant that you are a licensed healthcare professional authorised to perform or supervise echocardiographic examinations in your jurisdiction, and that you have the legal authority to enter into this agreement on behalf of yourself and, where applicable, your practice or institution.
EchoReport is a cloud-based clinical documentation platform that enables qualified cardiac sonographers, cardiologists, and other authorised healthcare practitioners to create, store, manage, and distribute structured echocardiogram reports. The Service includes features for entering echocardiographic measurements and findings, generating formatted PDF reports, managing patient records, and AI-assisted data entry.
The Service is provided on a subscription basis. Features available to you depend on your active subscription plan. We reserve the right to modify, add, or remove features at any time, provided that material changes to paid subscription features will be communicated with reasonable notice.
3.1 Professional Responsibility. You are solely responsible for the accuracy, completeness, and clinical appropriateness of all data you enter into the Service, all reports you generate, and all clinical decisions you make based on information processed through the Service. The Service is a documentation tool only and does not replace clinical judgement.
3.2 Patient Consent. You are responsible for obtaining all necessary patient consents, authorisations, and permissions required by applicable law and your professional regulatory body before entering patient data into the Service. This includes, but is not limited to, consent under POPIA (South Africa), GDPR (EU), HIPAA (USA), and equivalent laws in your jurisdiction.
3.3 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at synthera.apps@gmail.com if you suspect any unauthorised access to your account.
3.4 Prohibited Uses. You must not: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Service or its underlying infrastructure; (c) use the Service to store or transmit malicious code; (d) reverse engineer, decompile, or disassemble any part of the Service; (e) share your account credentials with any other person; (f) use the Service to process data for any purpose other than legitimate clinical documentation; or (g) use the Service in any manner that could damage, disable, or impair the Service.
4.1 Plans. The Service is offered on a tiered subscription basis. Current plan details, pricing, and feature inclusions are available within the Service. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
4.2 Payment. Website and PWA subscriptions are processed securely through PayFast. Where the Service is distributed through Google Play or the Apple App Store, the applicable store's in-app purchase system processes eligible native-app subscriptions and its store terms also apply. EchoReport does not store full payment-card details. By completing a recurring subscription, you authorise the applicable payment provider or store to charge the displayed subscription fee. Store prices, currencies, taxes and availability may differ by territory; website prices are quoted in South African Rand (ZAR) unless otherwise specified.
4.3 Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods, except where required by applicable consumer protection law.
4.4 Free Tier. The free tier is provided as-is with limited features and monthly report creation limits. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.
5.1 Our Intellectual Property. The Service, including all software, design, text, graphics, logos, and other content, is the exclusive property of Synthera Luminary Group and is protected by copyright, trademark, and other intellectual property laws. EchoReport™ is a trademark of Synthera Luminary Group. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.
5.2 Your Data. You retain full ownership of all patient data, clinical data, and report content that you create using the Service. By using the Service, you grant Synthera Luminary Group a limited, non-exclusive licence to process, store, and transmit your data solely for the purpose of providing the Service to you. We will never use your patient data for any other purpose.
5.3 Feedback. If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, royalty-free licence to use such feedback for any purpose without compensation to you.
6.1 Not a Medical Device. EchoReport is a documentation and reporting tool. It is not a medical device, diagnostic system, or clinical decision support system. The AI-assisted data entry feature is provided as a convenience tool only and must be verified by the qualified practitioner before use in any clinical document.
6.2 No Medical Advice. Nothing in the Service constitutes medical advice, diagnosis, or treatment recommendations. All clinical content generated through the Service reflects the input of the practitioner and is the practitioner's professional responsibility.
6.3 Limitation of Liability. To the maximum extent permitted by applicable law, Synthera Luminary Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: loss of data, clinical errors, patient harm, loss of revenue, or reputational damage. Our total aggregate liability to you shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.
6.4 Indemnification. You agree to indemnify and hold harmless Synthera Luminary Group and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa, without prejudice to your rights as a consumer under the laws of your country of residence.
For practitioners outside South Africa, nothing in these Terms limits any mandatory rights you may have under the consumer protection or data protection laws of your jurisdiction.
We reserve the right to suspend or terminate your account and access to the Service at any time if we reasonably believe you have violated these Terms, applicable law, or the rights of any third party. We will provide reasonable notice where possible, except in cases of serious breach or where immediate termination is required to protect the Service or other users.
Upon termination, you may request an export of your data within 30 days. After this period, your data will be deleted in accordance with our data retention policy, subject to any mandatory legal retention obligations.
We may update these Terms from time to time. We will notify you of material changes by email and by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
